PATIENT & USER TERMS OF SERVICE

1. INTRODUCTION AND ACCEPTANCE

By accessing, registering on, or using the SwiiftCare application or any related services (the "Platform"), you confirm that you have read, understood, and agreed to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you ("Patient" or "User") and SwiiftCare.

2. PLATFORM ROLE AND NATURE OF SERVICE

The Platform merely facilitates access to independent, licensed healthcare professionals who provide services directly to you. Any medical consultation, advice, diagnosis, treatment, or prescription constitutes a private professional relationship exclusively between you and the healthcare provider.

You expressly acknowledge and agree that:

• SwiiftCare is a technology platform, not a healthcare provider;

• SwiiftCare does not provide medical advice, diagnosis, treatment, or prescriptions;

• SwiiftCare does not operate as a hospital, clinic, or medical institution;

• SwiiftCare does not employ, supervise, or control healthcare practitioners.

3. ELIGIBILITY AND USER REPRESENTATIONS

To use the Platform, you represent and warrant that:

• You are at least eighteen (18) years old, or are using the Platform with the consent and supervision of a parent or legal guardian;

• All personal, health, and medical information you provide is true, accurate, complete, and current;

• You will use the Platform solely for lawful and legitimate medical consultation purposes.

You acknowledge that inaccurate or incomplete information may directly affect medical outcomes.

4. PATIENT RESPONSIBILITIES

You agree to:

• Provide complete, honest, and accurate health information during consultations;

• Independently assess and select healthcare providers on the Platform;

• Follow medical advice responsibly and seek clarification where needed;

• Maintain the confidentiality of your login credentials;

• Refrain from fraudulent, abusive, misleading, or unlawful conduct.

SwiiftCare does not recommend, endorse, or guarantee the suitability of any provider.

5. TELEMEDICINE ACKNOWLEDGEMENT AND RISK ASSUMPTION

You expressly acknowledge that:

• Telemedicine consultations are remote and may have limitations compared to in-person care;

• Certain medical conditions may be unsuitable for virtual consultation;

• Clinical outcomes may differ from physical examinations;

• Audio, video, or connectivity limitations may affect assessment accuracy.

You voluntarily assume all risks inherent in telemedicine services.

6. EMERGENCY CARE DISCLAIMER

The Platform is not designed for emergency medical situations. If you experience severe, worsening, or life-threatening symptoms, you must immediately contact local emergency services or visit the nearest hospital. Use of the Platform in such circumstances is strictly at your own risk.

7. PRACTITIONER RELATIONSHIP AND VERIFICATION DISCLAIMER

Healthcare providers on the Platform are independent professionals; SwiiftCare performs reasonable, document-based verification only; SwiiftCare does not guarantee the validity, accuracy, or ongoing status of any provider credentials.

8. TELEMEDICINE LIMITATIONS

You acknowledge that telemedicine:

• Has inherent limitations compared to in-person care;

• May not be suitable for all medical conditions;

• Requires heightened professional discretion and documentation.

9. PRESCRIPTIONS AND TREATMENT

All prescriptions are issued solely by independent professionals and not by SwiiftCare; SwiiftCare does not review, approve, validate, or endorse prescriptions; SwiiftCare bears no liability for medication misuse, pharmacy refusal, or adverse drug outcomes.

10. CONSULTATIONS, COMMUNICATION & RECORDS

All consultations must occur exclusively through approved Platform channels; Recording, storing, or sharing patient data outside the Platform without lawful consent is prohibited; You must maintain complete, accurate, and contemporaneous medical records for each consultation.

11. PAYMENTS

Consultation fees are as stated on the platform and may vary depending on service type. All payments are processed securely. Refunds, if applicable, will follow our Refund Policy.

12. USER INDEMNITY

You agree to fully indemnify, defend, and hold harmless, SwiiftCare, its directors, officers, employees, and affiliates from any claims, losses, damages, liabilities, costs, or expenses arising from:

• Patient injury, harm, or dissatisfaction arising from services gotten from the platform;

• Breach of applicable laws or professional obligations.

This indemnity survives termination.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• SwiiftCare shall not be liable for medical outcomes, misdiagnosis, treatment decisions, or patient harm;

• All indirect, incidental, consequential, or special damages are excluded;

• SwiiftCare's aggregate liability, if any, shall be limited to Platform fees paid by you in the preceding three (3) months.

14. SUSPENSION AND TERMINATION

SwiiftCare may suspend or terminate access without notice where you:

• Breach these Terms;

• Falsify credentials;

• Engage in unethical or unlawful conduct.

15. COPYRIGHT / TRADEMARK NOTICE

SwiiftCare owns or licenses all materials on this website. The materials are copyrighted and/or trademarked, and any unauthorised use of the materials may violate copyright, trademark, and other laws. Users may view and download the materials only for their personal, non-commercial use, provided all copyright and other proprietary notices contained in the materials or on any copies of the materials are provided. Users are not authorised to reproduce, publicly display, distribute or otherwise use them for any public or commercial purpose.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Federal Republic of Nigeria. All disputes shall be resolved by mediation and arbitration in Nigeria.

Provider Terms & Conditions of Service

TERMS & CONDITIONS OF SERVICE (PROVIDER)

Applies to: All medical and healthcare practitioners offering services through the SwiiftCare platform.

1. INTRODUCTION AND PLATFORM ROLE

These Terms & Conditions ("Terms") govern your access to and use of the SwiiftCare digital platform (the "Platform"). By registering, accessing, or providing services on the Platform, you acknowledge and agree that:

• SwiiftCare is a technology platform, not a healthcare provider;

• SwiiftCare does not provide medical advice, diagnosis, treatment, or prescriptions;

• SwiiftCare does not employ, supervise, or control healthcare practitioners;

• All healthcare practitioners on the Platform act strictly as independent professionals.

SwiiftCare's role is limited to providing digital infrastructure that facilitates interactions between patients and independent healthcare providers.

2. NATURE OF ENGAGEMENT

You expressly acknowledge and agree that:

• You are engaged on the Platform as an independent contractor, not an employee, agent, partner, or representative of SwiiftCare;

• Any medical consultation, advice, diagnosis, treatment, or prescription constitutes a direct professional relationship between you and the patient only;

• You retain sole and exclusive responsibility for all professional decisions, medical outcomes, and compliance with applicable laws.

Nothing in these Terms shall be construed as creating an employment, agency, joint venture, or fiduciary relationship between you and SwiiftCare.

3. ELIGIBILITY, REPRESENTATIONS & WARRANTIES

By registering and continuing to operate on the Platform, you represent, warrant, and covenant that:

• All documents, licenses, credentials, and information submitted are true, accurate, complete, and current;

• You hold a valid, active, and unrestricted license issued by the appropriate regulatory authority in your jurisdiction;

• You are legally authorised to practice and provide telemedicine services under Nigerian law and any other applicable jurisdiction;

• You will immediately notify SwiiftCare of any suspension, expiration, restriction, or revocation of your license;

• You will comply with all applicable medical, telemedicine, consumer protection, and data protection laws.

You acknowledge that any false representation constitutes a material breach of these Terms.

4. PROVIDER VERIFICATION DISCLAIMER

You expressly acknowledge and agree that:

• SwiiftCare conducts reasonable, document-based verification checks only;

• Verification does not constitute credential authentication, professional endorsement, or quality assurance;

• SwiiftCare does not guarantee the validity, accuracy, or ongoing status of any provider credentials;

• Patients are informed of, and accept, these verification limitations.

You remain fully liable for the authenticity and legality of your professional qualifications.

5. PROFESSIONAL OBLIGATIONS AND CONDUCT

You agree to:

• Comply strictly with the Code of Medical Ethics in Nigeria, applicable telemedicine guidelines, and international best practices;

• Exercise independent professional judgment in determining the appropriateness of remote consultations;

• Provide accurate, evidence-based, and professionally competent medical services;

• Refrain from providing care outside your scope of practice;

• Obtain informed consent prior to each consultation;

• Decline or refer cases requiring physical examination or emergency intervention.

6. TELEMEDICINE LIMITATIONS

You acknowledge that telemedicine:

• Has inherent limitations compared to in-person care;

• May not be suitable for all medical conditions;

• Requires heightened professional discretion and documentation.

You agree to clearly communicate these limitations to patients and advise local or emergency care where appropriate.

7. PRESCRIPTIONS AND TREATMENT

All prescriptions are issued solely by you, in your independent professional capacity; SwiiftCare does not review, approve, validate, or endorse prescriptions; The legal validity of prescriptions depends on applicable pharmacy and regulatory laws; You bear full responsibility for the legality, appropriateness, and consequences of any prescription issued.

SwiiftCare bears no liability for medication misuse, pharmacy refusal, or adverse drug outcomes.

8. CONSULTATIONS, COMMUNICATION & RECORDS

All consultations must occur exclusively through approved Platform channels; Recording, storing, or sharing patient data outside the Platform without lawful consent is prohibited; You must maintain complete, accurate, and contemporaneous medical records for each consultation.

9. PAYMENTS, DOCKET & DISPUTES

SwiiftCare may temporarily hold patient payments in Docket for administrative purposes; Release of payment signifies the patient's acknowledgment that the consultation occurred, not confirmation of medical quality or outcome; Refunds and disputes are handled through Platform procedures and do not constitute medical determinations; SwiiftCare does not adjudicate clinical competence or outcomes.

You are solely responsible for taxes, levies, and statutory deductions.

10. PROVIDER INDEMNITY

You agree to fully indemnify, defend, and hold harmless, SwiiftCare, its directors, officers, employees, and affiliates from any claims, losses, damages, liabilities, costs, or expenses arising from:

• Medical negligence, malpractice, or professional misconduct;

• Inaccurate, expired, or fraudulent credentials;

• Patient injury, harm, or dissatisfaction arising from your services;

• Breach of applicable laws or professional obligations.

This indemnity survives termination.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• SwiiftCare shall not be liable for medical outcomes, misdiagnosis, treatment decisions, or patient harm;

• All indirect, incidental, consequential, or special damages are excluded;

• SwiiftCare's aggregate liability, if any, shall be limited to Platform fees paid by you in the preceding three (3) months.

12. SUSPENSION AND TERMINATION

SwiiftCare may suspend or terminate access without notice where you:

• Breach these Terms;

• Falsify credentials;

• Engage in unethical or unlawful conduct;

• Lose or restrict your professional license.

SwiiftCare owns or licenses all materials on this website. The materials are copyrighted and/or trademarked, and any unauthorised use of the materials may violate copyright, trademark, and other laws. Users may view and download the materials only for their personal, non-commercial use, provided all copyright and other proprietary notices contained in the materials or on any copies of the materials are provided. Users are not authorised to reproduce, publicly display, distribute or otherwise use them for any public or commercial purpose.

14. GOVERNING LAW AND DISPUTE RESOLUTION
