By accessing or using the SwiiftCare platform — including our mobile application, web application (app.swiiftcare.com), and website (swiiftcare.com) — you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use our services.
2. Definitions
- "Platform" refers to the SwiiftCare mobile app, web app, and website collectively.
- "User" or "you" refers to any individual who accesses or uses the Platform.
- "Patient" refers to a User who seeks healthcare services through the Platform.
- "Provider" refers to a licensed healthcare professional offering services through the Platform.
- "Services" refers to all functionalities offered through the Platform, including but not limited to consultations, appointment booking, messaging, and health record management.
3. Eligibility
You must be at least 18 years old to create an account on SwiiftCare. Individuals under 18 may use the Platform only under the supervision of a parent or legal guardian who has registered an account. By using our services, you represent that you meet these eligibility requirements.
4. Account Registration & Security
To use certain features of the Platform, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials and not share them with others
- Immediately notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
5. Healthcare Services Disclaimer
SwiiftCare is a technology platform that facilitates connections between patients and healthcare providers. Please note:
- SwiiftCare does not provide medical advice, diagnosis, or treatment directly. All clinical services are provided by independent, licensed healthcare professionals.
- Consultations conducted through the Platform do not replace in-person medical examinations when clinically necessary.
- In case of a medical emergency, you should call your local emergency number immediately rather than relying on the Platform.
- Healthcare providers on the Platform are responsible for exercising their own professional judgment.
6. Appointments & Payments
When booking appointments through SwiiftCare:
- You agree to pay all fees associated with the services you book, including consultation fees and any applicable taxes.
- Payments are processed securely through our payment partners. We do not store your full payment card details on our servers.
- Cancellation and refund policies vary by provider. Please review the specific cancellation policy before confirming your appointment.
- Missed appointments without prior cancellation may incur fees as determined by the healthcare provider.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Harass, abuse, threaten, or intimidate other users or providers
- Upload or transmit viruses, malware, or any harmful code
- Attempt to gain unauthorized access to any part of the Platform or its systems
- Reproduce, distribute, or create derivative works from our Platform without explicit permission
- Use the Platform to collect user data for unauthorized purposes
8. Provider Responsibilities
Healthcare providers using SwiiftCare agree to:
- Maintain valid and current professional licenses and qualifications
- Provide accurate information about their qualifications, specialties, and availability
- Deliver healthcare services in accordance with professional standards of care
- Maintain patient confidentiality in compliance with applicable laws and regulations
- Respond to appointment requests and consultations in a timely and professional manner
9. Intellectual Property
All content, features, and functionality of the SwiiftCare platform — including but not limited to text, graphics, logos, icons, images, software, and design — are the exclusive property of SwiiftCare and its licensors, and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, SwiiftCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill arising from: (a) your use of or inability to use the Platform; (b) any healthcare services received through the Platform; (c) unauthorized access to your personal or health information; or (d) any other matter relating to the Platform.
11. Termination
We reserve the right to suspend or terminate your account at our discretion, without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users, providers, or SwiiftCare. You may also terminate your account at any time by contacting our support team. Upon termination, your right to use the Platform ceases immediately, though provisions relating to data retention and dispute resolution will survive.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration in Lagos, Nigeria.
13. Changes to These Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of SwiiftCare after any changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes via email or in-app notification.
